California Consumer Privacy Act of 2018 (CCPA / AB-375)
We have prepared our business and services to be in compliance with
the
CCPA, which became enforceable
on January 1, 2020.
Please note that the information we provide here should not be
relied upon as legal advice. We also do not intend to provide a
thorough analysis of the CCPA. Such analyses are plentiful and
available elsewhere on the Internet.
We suggest that you review the CCPA in its entirety to fully
understand its requirements if and as they apply to you.
Background
BIGLIST Inc. ("BIGLIST") provides email list hosting services for
clients, in which clients use and manage email lists. To use BIGLIST
services, clients collect subscriber information, which is stored
on the BIGLIST system. Subscriber information includes a subscriber
email address, and in some cases, an email address is the only
information stored by BIGLIST relating to a subscriber. Any
additional information a client opts to collect from a subscriber
is linked to that email address. This additional information may
include names, zip codes, gender, etc.
BIGLIST itself neither buys nor sells subscriber information.
Whatever subscriber information becomes stored on the BIGLIST system
remains the property of BIGLIST clients and as such, is always
accessible by BIGLIST clients.
Purpose
BIGLIST's business purpose for storing subscriber information is
to facilitate BIGLIST clients' use of BIGLIST email list services.
For information about BIGLIST clients' business purpose(s), subscribers
will have to contact the appropriate BIGLIST client.
Subscriber Information
Every subscriber on the BIGLIST system is automatically given a
password-protected web page, to which the subscriber has 24-hour
access. Any and all subscriber information is available to the
subscriber via this web page, including whichever BIGLIST client(s)
submitted the information to BIGLIST. BIGLIST does not otherwise
categorize subscriber information or sources of subscriber information.
The subscriber page also allows each subscriber to update their
email list preferences. For example, a subscriber may choose to
never be placed on an email list hosted by BIGLIST.
To the extent that subscriber information may be considered "personal
information" under the California Consumer Privacy Act of 2018
("CCPA"), BIGLIST provides subscribers rights to this information
consistent with the CCPA.
Notes
- Any information properly requested will be emailed to the
email address provided free of charge.
- Anyone requesting information will not be discriminated against
in any way.
- Alternatively, this information is available on each subscriber's
web page.
- BIGLIST is not required to provide personal information to a
consumer more than twice in a 12-month period.
- BIGLIST has 45 days to respond to verified CCPA requests for information.
CCPA Requests
Please submit your request under the CCPA by accessing the form on
your password-protected web page under
"Settings" → "My Privacy Settings" → "Manage BIGLIST Network Privacy Settings"
→ "CCPA data requests"
Conclusion
Again, this is not intended to be an exhaustive analysis, but rather
an explanation of the BIGLIST features that will assist our clients
in meeting the requirements of the CCPA. We recommend that our
clients review the CCPA as part of their own due diligence.
